The first type of premises liability case results when a criminal act has been committed against a tenant or permitted guest on a property. Examples of such cases include attacks committed in or on the grounds of apartment buildings, including murders, assaults, rape and other violent crimes. In many jurisdictions residential landlords are liable for injuries resulting from the criminal acts of third parties. In such cases the landlord and/or the management and security companies can be found liable if they failed to meet their duty to enact reasonable security measures to protect the victim. Such security measures can include the use of security guards, the installation and maintenance of proper fencing, cameras, and lighting around the property, and other measures reasonably designed to protect people on the property.

The second type of premises liability case results when shoddy or fraudulent home construction leads to properties with toxin-producing materials used in the home or the creation of conditions that allows molds to grow and spread throughout the home. Quite often clients seek out our assistance when their dream of home ownership has been ruined by the deceptive or negligent practices of a homebuilder or home repair contractor. The third type of premises liability case results when injuries are caused by the condition of property and the activities conducted on it.
